Recent high profile cases such as Qualcomm v. Broadcom and the Zubulake discrimination case have thrown the litigation support industry into the mainstream spotlight. These cases have made law firms responsible; how will you and your colleagues respond?
Part 1 of Qualcomm v. Broadcom: What Lessons Have We Learned discussed the details of the case and focused on outside counsel's exposure, potential consequences and preventative recommendations. Part 2 will explore the political, economic and pratical ramifications now that inside counsel have been exposed to direct public judicial sanction over discovery failures. Will Qualcomm and similar cases finally push corporate counsel to invest in the personnel, process and infrastructure required to implement a defensible, transparent discovery system?
